As a real estate attorney and business template specialist with over 12 years drafting buyer representation agreements across the U.S., I’ve helped hundreds of Georgia buyers and agents create clear, compliant exclusive buyer brokerage agreements. The August 2024 NAR settlement dramatically changed how buyer agents are compensated nationwide, and Georgia is no exception. A properly drafted exclusive buyer brokerage agreement Georgia is now mandatory before most agents can show you homes — and having the right template saves time, money, and headaches.
In this 2025 updated guide, I’m giving you my battle-tested, attorney-reviewed Exclusive Buyer Brokerage Agreement template for Georgia (free downloadable Word & PDF) plus everything you need to customize it correctly and stay compliant with Georgia Real Estate Commission (GREC) rules and the new NAR practice changes.

An exclusive buyer brokerage agreement Georgia is a written contract between a home buyer and a licensed Georgia real estate broker that appoints the broker (and usually their entire firm) as the buyer’s exclusive agent for purchasing property in Georgia. Once signed, the buyer cannot work with other agents during the agreement term without potentially owing compensation — even if they find the home themselves.
Since the National Association of REALTORS® settlement took effect on August 17 August 2024, Georgia brokers are required by both NAR rules and GREC policy to have a signed written buyer brokerage agreement before touring any property with a prospective buyer (except open houses).
Based on Georgia law (O.C.G.A. § 10-6A-1 et seq., the Brokerage Relationships in Real Estate Transactions Act) and current GREC/NAR requirements, here are the mandatory and recommended clauses:
| Section | Legal Requirement | Why It Matters |
|---|---|---|
| Parties & Date | Required | Identifies buyer and brokerage firm |
| Exclusive vs Non-Exclusive | Required | Most are “Exclusive Right to Represent” |
| Term (Start & End Date) | Required | Typical 3–12 months; auto-renewal clauses are risky |
| Geographic Area | Recommended | e.g., “State of Georgia” or specific counties |
| Buyer’s Agent Compensation | Required by NAR 2024 | Flat fee, percentage, or “seller-paid if offered” |
| Touring Agreement Language | Required before any showing | Can be separate or embedded |
| Termination Rights | Recommended | Unilateral termination with notice is buyer-friendly |
| GAR Form Reference (Optional) | Not required | Many agents still use GAR F301–F304 |
I’ve incorporated every 2025 requirement into the template below. It is intentionally buyer-friendly while remaining fair to agents.
Key buyer protections I built in:

Buyer name(s) exactly as they will appear on the purchase contract. Use the full brokerage name (e.g., “Atlanta Fine Homes Sotheby’s International Realty” not just “Sotheby’s”).
Check the “Exclusive Right to Represent” box — this is what 99% of Georgia agents now require post-NAR settlement.
I recommend 6 months maximum for first-time buyers, 3–4 months if you’re ready to buy immediately. Avoid 12-month or auto-renewing agreements.
Popular 2025 structures in Georgia:
Source: Georgia MLS compensation data Q1–Q3 2025 — 73% of listings still offer 2.5–3% buyer agent commission.
Georgia agents can attend open houses with you without an agreement, but the moment they unlock a door or schedule a private tour, the agreement must be signed.
| Feature | Exclusive | Non-Exclusive |
|---|---|---|
| Agent commitment level | High – prioritizes you | Low – you’re one of many |
| Required by most Georgia agents 2025 | Yes | Rarely accepted |
| Compensation obligation if you buy without agent | Usually yes | No |
| Best for serious buyers | Yes | No |
Bottom line: If you’ve interviewed agents and found one you trust, sign the exclusive agreement. You’ll get dramatically better service.
Can I terminate my exclusive buyer agreement in Georgia early?
Yes — Georgia law does not require “good cause.” My template includes a 30-day written notice termination clause (very buyer-friendly).
Do I have to pay my buyer’s agent if the seller pays them?
No, if your agreement says compensation is reduced by any seller-paid amount (which my template does).
Is the GAR buyer brokerage form mandatory?
No. Agents may use GAR forms F301–F304, but custom agreements like the one I’m providing are perfectly legal if they meet statutory requirements.
Can I use one agreement for new construction?
Separate “new construction touring agreements” are becoming common. My template includes optional new-construction language.
The 2024–2025 buyer brokerage changes caught many Georgia buyers off guard, but they actually give you more control when armed with the right information and template. Use my free 2025-updated exclusive buyer brokerage agreement Georgia template, negotiate confidently, and remember: the best agents are happy to explain every line.
Wishing you a smooth home-buying experience in Georgia!
