In the United States, the right of publicity is protected at both federal and state levels. If you photograph an identifiable person and use that image for commercial purposes (advertising, stock photography, prints for sale, website banners, social media promotion of your services, etc.), you generally need a signed model release form to avoid costly lawsuits.
Editorial or fine-art use is usually exempt (New York Times Co. v. Sullivan and most state “newsworthy” exceptions), but the moment money changes hands or the photo promotes a product or service, a release becomes essential.

According to the American Society of Media Photographers (ASMP) and years of case law, a valid adult model release form for photographers must include:

Below is the exact generic model release form I use. It is intentionally broad (unlimited worldwide use in all media in perpetuity) because that is what stock agencies and most commercial clients require.

Do I need a model release for street photography?
Generally no for editorial/fine-art use, yes if you sell the image for advertising.
Is a text message or email considered a valid release?
Only if it contains all required elements and you can prove identity. A signed PDF is far safer.
