As a U.S.-based commercial photographer and template designer with over 12 years of experience shooting advertising, editorial, and stock photography, I’ve signed (and had signed) thousands of model release forms. Today I’m giving you the exact free model release form template I still use in 2025 – available as both an editable model release form DOC and a ready-to-print model release form PDF. This photography model release form is written in plain English, complies with U.S. federal and state laws, and has been battle-tested from New York fashion shoots to Los Angeles stock sessions.

Why You Need a Model Release Form as a Photographer in the United States

In the United States, the right of publicity is protected at both federal and state levels. If you photograph an identifiable person and use that image for commercial purposes (advertising, stock photography, prints for sale, website banners, social media promotion of your services, etc.), you generally need a signed model release form to avoid costly lawsuits.

Editorial or fine-art use is usually exempt (New York Times Co. v. Sullivan and most state “newsworthy” exceptions), but the moment money changes hands or the photo promotes a product or service, a release becomes essential.

Key laws that make releases critical:

I’ve personally seen photographers pay five- and six-figure settlements for missing releases on stock images that ended up in national ad campaigns.

What Makes a Model Release Form Legally Binding in the USA?

According to the American Society of Media Photographers (ASMP) and years of case law, a valid adult model release form for photographers must include:

How to Fill Out and Use the Model Release Form Correctly

  1. Complete before or immediately after the shoot – Never try to get a release months later.
  2. Provide a copy to the model – Email or print on set.
  3. Scan and store digitally forever – I keep releases in both Dropbox and my CRM.
  4. Include shoot details – Date, location, and session ID make matching images easy.
  5. Pay at least $1 if no other compensation – Many states require consideration.

Common Mistakes Photographers Make with Model Releases

Frequently Asked Questions About Model Release Forms

Do I need a model release for street photography?
Generally no for editorial/fine-art use, yes if you sell the image for advertising.

Is a text message or email considered a valid release?
Only if it contains all required elements and you can prove identity. A signed PDF is far safer.

Can I use the same release for video and stills?
Yes – my template covers both photographs and video.

Does this template work for OnlyFans or adult content?
No. Adult performers require 2257-compliant releases. Use specialized templates instead.

Final Thoughts – Protect Your Photography Business

A solid model release form for photographers is the single most important legal document in commercial and stock photography. I’ve licensed images for six figures because my releases were airtight – and I’ve seen colleagues lose everything because theirs weren’t.

Download the free model release form PDF or DOC above, customize the bracketed sections with your name, and start shooting with confidence.

Remember: This is not legal advice. Always have your final releases reviewed by an attorney familiar with your state’s right of publicity laws.
