In New Jersey, custody is divided into two main categories:
N.J.S.A. 9:2-4 mandates that all custody decisions must serve the best interests of the child. The court considers 14 statutory factors, including parental fitness, stability, history of domestic violence, and the child’s preference (if mature enough).

You can file for custody in NJ if:
Custody cases are filed in the Family Division of the Superior Court in the county where the child has lived for the last 6 months (UCCJEA jurisdiction).

Married parents file under an “FM” docket (divorce). Unmarried parents file under an “FD” non-dissolution docket.

2025 filing fee for a new FD custody case: $300 ($250 filing + $50 mediation/parent education fee).
Fee waiver available if you qualify (Form 5A Application to Proceed as Indigent).
You can file in person or via the Judiciary Electronic Document Submission (JEDS) system.
After filing, you must serve the defendant with the summons and complaint (certified mail or sheriff). File proof of service with the court.
Almost every new custody case is referred to the free Parenting Education Program (4 hours) and at least one economic mediation session through the county.
If the child is in immediate danger, you can file a verified complaint/application for temporary emergency custody under Rule 5:8-1. The duty judge can grant relief the same day without notice to the other party.

To change an existing order, you must show a substantial change in circumstances (Lepis standard). File a Motion (Form CN 10485) with supporting certification.
