Unlike almost every other state, North Carolina uses a Due Diligence system instead of traditional inspection contingencies. The buyer pays a non-refundable due diligence fee (typically $500–$5,000) directly to the seller in exchange for the unilateral right to terminate the contract for any reason before the due diligence deadline.

If you’re selling without an agent, you still need a binding, enforceable contract. This NC FSBO real estate contract removes all broker commission language and includes the mandatory Lead-Based Paint disclosure for homes built before 1978 (federal law — see EPA.gov).

Is the North Carolina Offer to Purchase legally binding once signed?
Yes — immediately upon delivery and acceptance, even before earnest money is deposited (see Snipes v. Lassiter, 2023).
Can I use this for new construction?
Yes, but attach the builder’s addendum. The core form is identical.
Do I still need an attorney?
North Carolina is one of the few states where attorneys must conduct closings. You’ll still need one for title search and deed preparation.
