A separation of assets agreement (sometimes called a postnuptial agreement or marital property separation agreement) is a written contract between spouses that defines which property and debts are separate and which remain marital/community property. Unlike a prenup (signed before marriage), this document is executed during the marriage.

Below is the exact structure I use in my paid client agreements, now free for you.
Clearly state both spouses’ full legal names, date of marriage, and current addresses. Example:
“This Separation of Assets Agreement (‘Agreement’) is entered into on November 19, 2025, between John Michael Smith (‘Husband’) and Sarah Elizabeth Smith (‘Wife’), collectively referred to as the ‘Parties,’ who were married on June 15, 2018 in Travis County, Texas.”
Explain why you’re signing this. Many clients copy this paragraph verbatim:
“The Parties intend to live separate and apart but wish to remain legally married and have not ruled out future reconciliation. The Parties desire to define their respective property rights and obligations during this period.”
List assets that will remain 100% separate. My template includes ready-to-fill schedules:
Critical clause for community-property states:
“All earnings, wages, bonuses, stock options, retirement contributions, and property acquired by either Party after the Effective Date shall be the separate property of the acquiring Party.”
Protect yourself from your spouse’s credit cards or business loans. The template contains an indemnification clause that has held up in every case I’ve taken to court.
Most reconciling couples waive temporary support. If you need support, delete this section and consult local counsel.
