A 30 day eviction notice Florida is the statutory written notice a landlord must give a tenant to terminate a month-to-month tenancy or certain other tenancies when there is no fixed-term lease or the lease has expired. Florida Statute § 83.57(3) requires at least 30 days’ written notice before the end of the monthly rental period (see Florida Statutes § 83.57).
Note: If the tenant has violated the lease (non-payment of rent or other material breach), you will usually use a 3-day notice or 7-day notice instead. See IRS and Florida Bar resources on IRS.gov for related tax implications of eviction proceedings.

If the tenant does not move out by 11:59 p.m. on the termination date, you may file a “Complaint for Tenant Eviction” (sometimes called Summary Procedure under Chapter 51, Florida Statutes).
