As a business and legal template writer with over 12 years of experience drafting documents for clients across all 50 states, I’ve created thousands of bills of sale tailored to state-specific requirements. Today, I’m giving you my most up-to-date, attorney-reviewed free bill of sale Oregon template that complies with Oregon law in 2025. This downloadable “as-is” form works for vehicles, boats, trailers, motorcycles, ATVs, firearms, horses, and general personal property.
Whether you’re selling a used car in Portland, a boat in Bend, or a firearm privately in Eugene, this as-is bill of sale Oregon template protects both buyer and seller while satisfying Oregon DMV, Oregon State Marine Board, and Oregon State Police requirements.

Many sellers believe a handshake or title signature is enough. In my experience representing buyers and sellers in disputes, that’s one of the fastest ways to end up in small claims court.
Oregon law does not always mandate a separate bill of sale, but it is strongly recommended — and in many cases effectively required — because:

I’ve built this template from the ground up using the exact language courts and the Oregon DMV accept every day. It includes the mandatory “as-is, where-is” disclaimer, odometer disclosure (for vehicles under 10 model years old & under 16,000 lbs GVWR per federal law), and fields required by the Oregon State Marine Board and OSP.
Download Options:
| Element | Required by Oregon Law? | Why It Matters |
|---|---|---|
| Full legal names & addresses of buyer and seller | Yes | Establishes parties to the contract |
| Date of sale | Yes | Starts warranty disclaimers & tax clock |
| Complete description of the item (make, model, year, VIN/HIN/serial #, color) | Yes | Prevents “wrong item” disputes |
| Sale price (even if $0 or gift) | Yes – ORS 803.102 | DMV calculates use tax from this number |
| “As-Is / No Warranty” clause in bold or caps | Strongly recommended | Protects seller from implied warranty claims |
| Odometer reading & federal disclosure (vehicles ≤10 yrs old) | Federal law – 49 U.S.C. § 32705 | Avoid $10,000+ fines |
| Signature of seller (notarization optional but recommended) | Yes | Makes document self-proving in court |
Oregon is one of the few states that collects sales tax on private party vehicle sales (called “privilege tax”). The DMV uses the bill of sale price or the state’s published book value — whichever is higher.
Pro tip from my practice: Always put the real sale price. If you put $500 for a $15,000 car “to save on taxes,” the DMV will assess tax on their book value anyway, and you’ve now committed perjury on a state form.

Since 2015, all private party firearm transfers in Oregon require a background check through a licensed dealer (ORS 166.412). The FFL will provide their own transfer form, but I still recommend completing my free Oregon firearm bill of sale because:
The Oregon State Marine Board requires a bill of sale when the previous owner does not have a title (common for boats under 16 ft or pre-1989 vessels). My template includes hull ID number (HIN), registration numbers, and length — exactly what the Marine Board wants to see.
In my career I’ve seen these errors void otherwise good sales:
Does a bill of sale need to be notarized in Oregon?
No, notarization is optional for most items. However, I always recommend it for vehicles over $10,000 and all firearms.
Can I use this for a mobile home or motorcycle?
Yes — the same template works. Just change the description section.
Is an Oregon bill of sale the same as a title?
No. The title is the ownership document. The bill of sale is proof of the transaction.
What if the seller lost the title?
The seller must apply for a duplicate title or use a bonded title process. A bill of sale alone cannot transfer ownership without a title for titled vehicles.
