Updated for 2025 PAR Standard Form ASR changes & current PA law
This Pennsylvania real estate sales agreement complies with the Pennsylvania Association of Realtors® (PAR) Standard Form ASR structure while remaining fully customizable for private (for-sale-by-owner) transactions.
The PA real estate contract, officially titled the “Agreement of Sale and Purchase,” is the legally binding document that outlines the terms under which a buyer agrees to purchase and a seller agrees to sell residential real property in Pennsylvania. Unlike many states that use short “offer” forms followed by a longer contract, Pennsylvania combines the offer and the enforceable contract into one document—once both parties sign, the deal is typically binding (subject to contingencies).
The most widely used version is the Pennsylvania Association of Realtors® Standard Agreement for the Sale of Real Estate (Form ASR), but private parties frequently use simplified or customized versions of the PA standard agreement of sale.
From my experience closing over 800 Pennsylvania transactions, the Commonwealth has several buyer- and seller-protection features not found in most states:
| Section | Why It Matters in PA | Common Mistakes |
|---|---|---|
| 1. Property Description & Inclusions | Must list appliances, fixtures, and personal property staying with the home | Forgetting to exclude heirloom chandelier → litigation |
| 2. Purchase Price & Deposit | PA law requires deposit be held by licensed escrow agent | Handing deposit directly to seller (illegal) |
| 3. Mortgage Contingency | Default 30 days in most templates—critical in rising-rate environments | Waiving in multiple-offer situations without counsel |
| 4. Home Inspection Contingency | PA buyers have strong repair negotiation rights | Using “as-is” language that unintentionally waives rights |
| 5. Title & Municipal Requirements | PA requires resale certificate, lien letters, dye tests in many areas | Missing township-specific requirements → delayed closing |

No. PAR forms are copyrighted and only PAR members (realtors) may use the official version. Private parties and attorneys routinely use equivalent forms like the one I’m providing.
You can sell “as-is,” but Pennsylvania law still requires the Seller Property Disclosure, and buyers can still walk away during the inspection contingency period unless explicitly waived.
Typically 1–3% of purchase price, but I’ve seen everything from $1,000 on a $150k house to $100k on a $2M property. The key is that it must be held in a proper escrow account.
